As we are drawing close to the UK leaving the EEA Treaty Rights and those coming to the UK from EEA National States, will need a visa post 1st January 2021. As part of the flexibility policy, the Home Office are introducing the frontier worker work permit to allow EEA national, to be employed in the UK.
Where you are employed as a frontier worker prior to 31st December 2020, you are permitted to enter the UK until EU rules ends. However post 1st July 2021, you will need to apply for the work visa.
In order to apply for the frontier working visa, you must be living outside of the UK and have started to work in the UK prior to 31st December 2020. The working visa is valid for 5 years and can also apply for a retained frontier work visa if you have worked in the UK for more than 2 years.
Where you have not worked under the working visa, and have entered the UK post 31st December 2020, then you would have to apply under the point based system. You can find more details by clicking here.
At the time of the application, your primary residency should not be the UK and must provide evidences.
How to apply for the Frontier Work Visa
To apply for the frontier work visa, this is done online and you must then submit the correct supporting documents.
When making the application, you must ensure all specified documents are provided from the Appendix of the Immigration Rules. Failure to provide those may result in your application being refused. There are 2 policies, so please check prior making any application to the UK Visas & Immigration Team.
Application successful under Frontier Work Visa
Once the application has been approved by the UK Visas & Immigration Team, you would be issued with a digital frontier work permit. However there may be circumstances where a visa is issued or an email would be sent.
Application being refused as a Frontier Work Visa
If your application is refused under the frontier work visa, then the decision letter will let you reasons why the application has been refused. You may have a right to appeal the decision through the administrative review process.
Renewing your work permit under Frontier Work Visa
The visa is granted for 5 years or every 2 years where you applied under the retained rights. You must ensure the evidences are provided at the date of application and you meet the eligibility requirements.
